1. Agreement

These Terms govern your use of the ClickyDots application and related materials ("the App"), provided by Pawel Krupski ("I", "me"), a natural person based in Poland. By installing or using the App, you agree to these Terms. If you do not agree, do not use the App.

2. License

I grant you a personal, worldwide, non-exclusive, non-transferable license to install and use the App for your own use, on Macs that you own or control, in accordance with these Terms. This is a license, not a sale of the software itself. The non-transferable nature of the license is subject to any mandatory rights you may have under applicable law.

3. What you may not do

You may not:

resell, rent, sublicense, or redistribute the App;
reverse engineer, decompile, or disassemble the App, except to the extent such restriction is prohibited by applicable law (e.g. permitted interoperability rights under EU law);
remove or alter any proprietary notices;
use the App in violation of applicable law.

4. Your notes are yours

The App stores your notes as plain Markdown files on your own device (or your own iCloud, if you choose). You retain all rights to your content. I claim no ownership of it and, as described in the Privacy Policy, I do not receive it. You are responsible for backing up your own files.

5. Ownership

The App, its design, code, and branding are owned by me and protected by intellectual-property laws. Except for the license in Section 2, no rights are transferred to you. Bundled third-party components (e.g. Sparkle, and the bundled fonts) remain under their respective licenses, included with the App.

6. Updates

I may provide updates through the in-app updater (Sparkle). Updates may add, change, or remove features. Unless an update comes with different terms, these Terms apply to it. I am not obligated to provide updates indefinitely.

7. Purchases, taxes, and refunds

The App is sold through Paddle, the Merchant of Record, which handles the transaction, applicable taxes/VAT, invoicing, and refunds. Your purchase is also subject to Paddle’s buyer terms.

Nothing in these Terms limits any mandatory statutory rights you have as a consumer under Polish/EU law, including the 14-day right of withdrawal for digital content. Where digital content is delivered immediately and you give the express consent required by law during checkout (acknowledging that you lose the right of withdrawal), that right may no longer apply. 8. Disclaimer of warranties

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied (including merchantability, fitness for a particular purpose, and non-infringement). I do not warrant that the App will be error-free or uninterrupted. This section does not exclude warranties that cannot be excluded under applicable consumer law.

9. Legal guarantee of conformity

Nothing in these Terms limits the legal guarantee of conformity for digital content that applies to consumers under EU law (minimum two years from delivery of the content).

10. Limitation of liability

To the maximum extent permitted by applicable law, I am not liable for indirect, incidental, special, or consequential damages, or for loss of data or profits, arising from your use of the App. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for gross negligence, willful misconduct, death or personal injury, or mandatory consumer protections (including the legal guarantee of conformity). Because you control where your notes are stored and their backup, please keep your own backups.

11. Termination

This license ends automatically if you materially breach these Terms. On termination you must stop using and delete the App. Sections that by their nature should survive (ownership, disclaimers, liability, governing law) survive.

12. Governing law

These Terms are governed by the laws of Poland and applicable EU law, without prejudice to the mandatory consumer-protection rules of your country of residence. Disputes are subject to the competent courts, save for any consumer’s right to bring a claim in their place of residence.

13. Changes to these Terms

I may update these Terms; the "Last updated" date will change and material changes will be noted in release notes. Continued use after changes means you accept the updated Terms.
